Claire Lyon is a Consultant Partner in our Litigation & Dispute Resolution and Property Litigation Teams.

Claire is an experienced property litigator, undertaking a very broad range of real estate disputes (including property insolvency) as well as landlord & tenant disputes in both the commercial and residential sectors. She also undertakes bridging loan advice, as well as bridging loan recovery-related work.

She acts for both commercial and residential private clients, investment companies as well as financial institutions. She supports her bridging loan clients with real estate finance advice as well as the recovery side of the finance, which often involves appointing and working with (or for) LPA Receivers.

Her clients comprise of limited companies and plcs as well as individual property owners, property management companies, landlords, tenants and financial institutions.

Claire Lyon is a member of the Property Litigation Association, Women in Property, Property Litigation Association and was a working party committee member for PACT (Professional Arbitration on Court Terms).

Claire is a dog lover and enjoys long walks in the outdoors, as well as gardening.

Recently acting for 59 leaseholders of a tower block in central Bedfordshire, opposing and appealing all of the improvement notices served by the Council in respect of defective cladding. The result was that the Tribunal found in favour of the leaseholders and held that different statutory regimes under the Housing Act 2004 and the Building Safety Act 2022 will not operate in isolation. This was one of the first cases to consider this issue post-Grenfell, further to the implementation of the Building Safety Act 2022.

Acting for a developer client following the Council’s triggering an overage provision in a s106 agreement.

Acting for a landlord in a dilapidations claim against a well-known charity and securing a six-figure settlement for the landlord.

Acting for a management company and landlord in residential possession proceedings where the leaseholders (unsuccessfully) claimed business tenancy status.

Acting for a landlord in the First Tier Tribunal in response to a claim by the leaseholder for the determination of service charges.
