Acuity’s Construction group is renowned for its breadth of expertise across a variety of sectors.  We advise on all forms of infrastructure related projects including leisure and office facilities, urban regeneration, renewable energy, civil infrastructure, social housing, private developments, public projects, manufacturing, healthcare and individual projects.  Our group has a particularly strong reputation for major development work and has worked on a wealth of high-profile and innovative projects, delivering new models of city-centre living, commerce, creativity, and entrepreneurship.  

In doing so, we advise from feasibility through to completion and beyond in both an advisory role and the resolution of disputes.  We have experience of all forms of construction agreements including NEC, FIDIC, JCT, iChem and bespoke arrangements, often including multiple parties and spanning a range of clients.  We act for funders, developers, contractors, social housing providers and others. 

We hold an unrivalled reputation in all forms of construction dispute resolution.  In acting on projects across the United Kingdom and abroad, our group manages disputes related to prominent projects and marquee developments with particular experience in tall buildings, fire safety, project delay, professional negligence, structural failures and contract terminations.  We hold particular experience in adjudication and the unique challenges it brings.  We take a pragmatic approach to both dispute avoidance and resolution, working with you to achieve the result that works for you.

Work highlights

Advising an innovative commercial property developer specialising in occupier-led property solutions in connection with itsCardiff Interchange construction project, a £100 million development of a new transport interchange, which includes astate-of-the-art bus terminusand a mixed-use development incorporating over 45,000 square metres, comprising a new grade A* office space, retail premises and accommodation consisting of 318 apartments  

Advising a developer upon its entitlement to recovery of time and cost (under JCT terms) due to the delayed completion of a £120m mixed use commercial/residential scheme within a city centre location arising from the defective design and construction of numerous structural concrete balconies at risk of disproportionate collapse.  

Advising on the development of Plots 1 and 2 at Central Quay, Cardiff City Centre, to create approximately 700 new residential units, varying from studios to three-bedroom penthouse apartments. This two-acre site also includes commercial units, bars, restaurants, and leisure facilities to create an entirely new city centre residential area at the site of the old Brains Brewery  

Advising a social housing provider in multi party proceedings upon its recovery of remediation costs and associated costs arising from the defective design and construction of a high dependency elderly care residential scheme, including claims under the Defective Premises Act 1972 / Building Safety Act 2022 and the Civil Liability (Contribution) Act 1978. 

Advising on a variety of contracts (under NEC terms) and associated contract documentation related to the £1.25bn development of the electrical arc furnace facility at Tata Steel in Port Talbot, South Wales. 

Advising a main contractor in Adjudication proceedings (under NEC terms) arising from delays, compensation events and associated financial differences related to the completion of a hydro electric reservoir project  

Advising on the £60 million development of “The Ledger”, the first building developed on the Central Quay site, forming a key focal point to the south of Cardiff Central Station. The building will consist primarily of office accommodation, with a large public square linking the building to the rear of the Station and potential future metro stop  

Advising a developer in Adjudication and subsequent proceedings before the High Court in respect of delays/disruption, defective design and construction of the development of multiple ultra-high value residential development in a central London location (under JCT terms).
