Overview

Our property litigation team handles a wide range of real estate disputes for landlords, tenants, buyers, sellers, property investors, developers, social housing providers and high-net-worth individuals.  

The team is skilled in navigating the property industry and can provide innovative advice on a wide range of issues. Whether the issue is complex, high value, or business critical, our team of skilled property litigators have experience in analysing complex matters, advising on risk / rewards and strategy, and guiding clients through to pragmatic resolutions that work for the client’s business or individual requirements. 

The property litigation team has extensive experience navigating matters through various courts and tribunal procedures, through to trial. Importantly, they also regularly act for clients in mediation and other forms of alternative dispute resolution – providing clients with the ability to try and settle their property disputes through negotiation and avoid the need for court proceedings where possible.

Work highlights

  • Advising a resident management company in relation to a multi-million pound dispute with its developer landlord concerning a multitude of fire safety issues at its 900+ apartment development (including cladding, insulation, compartmentalisation and automatic opening vents), and involving Defective Premises Act 1972 and Building Safety Act 2022 claims. 
  • Advising an airport owning client in relation to a number of contentious boundary issues arising from the client’s intention to build a solar farm upon its land. 
  • Representing a national marina owning company in a multi-million-pound dispute with a local council over its obligations to repair and maintain the stability of land adjacent to the client’s property following a number of landslides. 
  • Acting for a developer landlord in a dispute with leaseholders of properties forming part of a major transformative city-centre redevelopment project. 
  • Acting for numerous registered social landlords in defending and resolving disrepair claims brought by tenants. 
  • Advising a number of registered social landlords in possession and injunction cases relating to anti-social behaviour and criminal activities.
