Work highlights

  • Acuity advised Coastal Housing Group Limited (Coastal) on its £28.5 million acquisition of Plot B3, Kings Road, Swansea Waterfront, for the development of 104 residential homes and two commercial units. The firm also advised on the building contract, contractor warranties, performance guarantees, and professional appointments. The project was the largest grant-funded social housing development in Wales last year. Acuity continues to offer ongoing advice on sectional agreements, licences, and construction warranties. 
  • Acuity advised in connection with a package deal (using the JCT D&B 2016) between housing association Trivallis and Bluefield LandThe transaction related to the former Button Factory in Porth. Simultaneously, on completion of the purchase contract, the JCT was entered into between Trivallis and Bluefield for Bluefield to deliver 10 new energy efficient homes that will cost tenants less to heat, while also helping them produce fewer carbon emissions. The site will include 4 x 1 bedroom walk up flats, 6 x 2-bedroom houses.  
  • Acuity provides legal services to a not-for-profit housing association client, addressing various housing management issues. This includes handling cases related to anti-social behaviour, criminal activities, property maintenance, failure to provide access for services, capacity and Equality Act 2010 issues, abandonment, and disrepair claims. They also offer advice on the Renting Homes (Wales) Act 2016. Acuity has represented the client in multiple court hearings, with many cases resolved without needing court action. 
  • Acuity provided training relating to a housing association on the requirements for health and safety, Housing Associations’ obligations and individuals’ obligations and strategies to prevent accidents and their consequences. Topics covered included: Health & Safety law for an organisation and individuals; Understanding the consequences of a health and safety incident for organisations and individuals; How effective leadership can prevent an accident in the first place and reduce the serious consequences if an incident does occur and how to respond and investigate a serious accident.  
  • Acuity continues to be instructed by a housing association in relation to any property-related disputes across its residential, leasehold, and commercial portfolio. This includes, in the last 12 months, action for non- payment of rent and for other breaches of lease terms in their commercial property portfolio. Dilapidations claims; disputes relating to service charges and boundary disputes/adverse possession/trespass claims.   
  • We have advised a charitable housing association to all its housing management cases. These include possession and injunction cases relating to anti-social behaviour and criminal activities; actions in relation to properties not being kept in the required condition by contract holders; injunction actions relating to contract holders’ failures to provide access, e.g. for the annual heating and smoke alarm service; advice in relation to cases involving issues relating to capacity and Equality Act 2010; disrepair claims. Also, advice in relation to Renting Homes (Wales) Act 2016.
