Acuity Law’s insolvency litigation team advises officeholders, creditors, directors and shareholders on the full range of disputes that arise out of corporate insolvency.

Insolvency processes frequently give rise to contentious issues — from petitioning to wind up a company, to investigating and pursuing claims against directors or third parties who benefited from transactions before insolvency. These disputes require a combination of insolvency law expertise and hard-edged litigation skill.

We act for administrators, liquidators and trustees pursuing claims to recover value for creditors, and for directors, shareholders and other respondents defending claims brought against them. Whichever side of the table our client sits on, our focus is on securing the strongest achievable outcome as efficiently as possible.

We are commercially realistic about the cost and risk of litigation and will always consider negotiated or alternative routes to resolution alongside formal proceedings where that serves our client’s interests.

Director
Instructed on behalf of a director to defend a claim brought by Administrators alleging preferential payments under s.239 of the Insolvency Act 1986, a transaction at an undervalue under s.238, and breach of directors’ duties.
Liquidators
Advising the Liquidators on a potential claim against the former director of a liquidated company regarding certain preferential payments (including director’s loan account repayments and pension contributions), potentially unlawful dividends, wrongful trading, and breach of directors’ duties.
Secured Charge Holder
Instructed on behalf of Secured Charge Holder to assist with the appointment of a Receiver.
London based hotel
Successfully achieved a rescue and solvent return of a company in administration running a large London based hotel.
