EU Intellectual Property Rights

International Registrations as at 31 December 2020 which designated the EU, or, EU trade mark or design rights that were pending as at 31 December, will no longer provide protection in the UK.  They will not have been granted automatic, comparable UK protection as with EU trade marks or designs which were already registered.  If you therefore need protection in the UK, you will need to file a new application.

More information about this can be found in our article here.

Please bear in mind the new filing requirements at the UKIPO which require a UK address to be connected with any new UK trade mark or design right application at the UKIPO.  If you are not based in the UK/do not have a UK address for service, you can use a UK based representative such as Acuity to overcome this new requirement.

Should you have any queries about the matters raised in this article or any other queries as to your intellectual property rights, please do not hesitate to contact our IP Partner, Cordelia Payne cordelia.payne@acuitylaw.com.
