The law which determines whether someone is employed, self-employed, or a worker is a complex area, particularly in light of the recent cases of Hughes v Rattan and Sejpal v Rodericks Dental Ltd.
There is and always has been a strong legal argument that associates are and always have in fact been employees, and an even stronger argument that they are workers with entitlement to sick pay and holiday pay. With this topic coming under renewed scrutiny by HMRC and the courts, it is vital to review the position once again to consider what can be done to maintain associates’ self-employed status and the risks to practice owners by continuing to engage associates on a self-employed basis.
